跟童鞋们交流下，顺便请教下大家。如果发的版面不对，请版主大人删下哈，咳咳~~

楼主目前跳槽进行时，新公司HR说一般H1B transfer要4-6周，所以给offer的时候说正
式开始上班的时间定在11月10号。（楼主是九月最后一个周五面试，接下来的周一得
到offer，
然后同一周周末前接受的。。。）所以如果这样算起来，确实是6周。

但是其实上周楼主才刚刚递交所有H1b transfer所需材料。同时不知道新公司必须递交
的材料是否已经一并交给律师。这样一来，就是5周或4周，如果程序顺利，应该正式入
职前拿到新签证没问题？网上查了下说理论上收到收据就可以开始工作。

因为新公司所在地比较远，楼主本来打算提前一周多过去。刚刚和好友聊天，被指出，
H1b之间不能有gap（很惭愧，帮楼主发现问题的好友是绿卡身份，从来不曾以H1b身份
工作过，反倒知道的比楼主多）上网查了查，好像是有此一说。

于是楼主困惑了。。。

1.是否提交transfer就不算gap了？

2.如果gap还是存在，是不是最好待到11月7号才到新公司那边去？（8-9号是周末）
现在的公司pay check是一月一付，本来打算待到月底就过去的。

3.或者如果到月底前这段时间内收到receipt 就可以？

2.真实案例：
某人，01年泡沫破裂的时候被layoff，没有离境，没有换身份，呆着找工作，找了几个
月才找到，办 h1 transfer，中间实际非法居留不到5个月，新公司给他申请h1
transfer很幸运办成了，在新公司工作一段时间，公司帮他办绿卡，140批准，485被驳
回，就是因为这个非法居留

对于h1 transfer，中间能不能有gap，我记得移民局前几年有过解释，不是0容忍，完
全看处理官员的意见，也就是说，有一天gap，处理的那个人不高兴，也可以拒绝，有

周甚至两个月gap，处理的人那天心情好，批准了，也不算违背法规

但是，这一次transfer批准，并不代表那个gap就从此被掩盖了，以后被拿出来做文章
，还是可以的

这个把楼主吓一跳，回头再想想是不是指的是transfer，而不是工作开始的时间？


3.4件重要的事：

4 important things to know before you file the H1B Transfer:

1) You must be employed in H-1B status on the date
that the H-1B Transfer petition is filed with USCIS.

2)The earliest date that you are allowed to start work
is the day that USCIS receives the I-129 H-1B Transfer petition.

3)If there is a gap in your employment, meaning that
you stopped working for your H-1B employer prior to
the H-1B Transfer filing with USCIS,
you should consider Premium Processing.

4)If you do not have paystubs, you may submit other documentation
to prove your employment status, such as am Unpaid Leave of Absence Letter.

话说这些条条款款又把楼主看晕了，值得庆幸的是，楼主还没给现在的公司说要跑路，
是不是偶尔伤一次人品，等到新公司都弄好了再通知现在的公司呢？通知现在的公司的
离职时间就定在11月10号？因为需要飞过去，所以楼主肯定周末就会先过去，只是周一
（11月10号）那天就不来上班，这样好吗？咳咳。。。厚着脸皮说下，楼主的rp好像一
直不错，没伤过。。。
